Why Reforming Facility Assessments Matters for Our Community

DO YOU WANT ANOTHER ACCESS TO YOUR HOME BESIDES SECOND STREET?

 

YOU PAID FOR IT THROUGH MELLO-ROOS OR CFD TAXES.

 

On March 16, 2005, the City Council of the City of Imperial adopted a resolution stating its intention to establish Community Facilities District No. 2004-2 (Mayfield) (the “District”). The District was formed to include a section identified as Improvement Area No. 1, which includes 185 parcels east of “P” Street (Clark Road); west of Brighton; north of Huston Road; and south of a newly proposed 4th Street. The City agreed with the Mayfield developer to borrow money via municipal bonds and tax the homebuyers in Area No. 1 to pay off the bonds over time. In their public disclosure documents, the City said the money would be used to finance, among other things, certain public facilities (the “CFD Facilities”) to meet the needs of new development within Improvement Area No. 1. (See, Official Statement City of Imperial Community Facilities District No. 2004-2 (Mayfield), 2007 Special Tax Bonds, page 1.) In this public disclosure mandated by law, it stated: “At present, access is via Clark Road only. When the Mayfield project is complete, access will also be from Huston Road.” (Official Statement, Appendix F – Page 5.)

 

BUT THE CITY WILL NOT PROVIDE IT FOR YOU!

 

Of course, the recorded map for Area No. 1 also shows the neighborhood being connected to Clark/P Street via the proposed extension of 4th Street. Now, almost 20 years later, the promised streets have not been built. In fact, the City’s February 25, 2025 report for the District (page 2), admitted that “…the funds designated for public improvements to be financed with the Net Bond proceeds have been fully spent.” That means the City has no plans – or money – to build the promised roads.

 

WHAT’S WORSE IS THAT THE CITY STILL WANTS TO TAX YOU MORE!

 

So, the City is taxing the homeowners in Mayfield Area No. 1 for roads the City promised to build but never did and never will. Nevertheless, the City’s plan is to continue taxing you, if you live in the District, for another 12 years for promises they did not keep.

 

HOW MUCH MORE DO THEY WANT TO TAX YOU? YOU CAN FIND OUT!

 

The official website of the City states: “There is an option to prepay the annual Special Tax for Facilities. To request a prepayment quote, the property owner should contact the City’s Special Tax Administrator, Koppel & Gruber Public Finance, at (888) 510-0290.”

 

WE DON’T THINK THAT’S FAIR

 

A new builder, Novalk, LLC, has purchased the unbuilt lots north of Farmington in the Mayfield CFD, Improvement Area No. 1.

Novalk paid all the unpaid property taxes on these lots at the County’s tax sale. Then, Novalk offered to pay off the remaining bonds with the 2025/6 assessment, so you don’t need to pay any more Mello-Roos taxes for CFD Facilities. Novalk offered to build 4th Street at its own expense but the City refused.

 

So, we are asking you to join us to repeal these unfair taxes. Together we can cancel these taxes for all future years and build an additional access to the neighborhood on Fourth Street. Otherwise, the City is planning on taxing you for the next 12 years.
